1. SCOPE OF APPLICATION

The General Terms and Conditions (GTC) regulate the relationship between the customer (hereinafter referred to as the customer) and WERA DESIGN, Julia Wüest, 4052 Basel (hereinafter referred to as WERA DESIGN). By placing an order, the customer accepts www.wera-design.ch published terms and conditions.

 

2. PRESENTATION OF THE SHOP ITEMS

The articles were presented to the best of our knowledge and truthfully reproduced. However, it is a fact that the color scheme can have different effects on the various devices. Therefore, WERA DESIGN gives no guarantee for the presentation and color representation. If you have any questions or are unclear, the customer must contact WERA DESIGN using the contact details on the website.

 

3. CONCLUSION OF A CONTRACT

The order is placed by completing the order process in the online shop or by placing an order by email or Instagram. The purchase contract is concluded by sending the order confirmation from WERA DESIGN to the customer.

 

4. AVAILABILITY OF GOODS

WERA DESIGN gives no guarantee that the products listed on the website are available at the time of ordering. Therefore, all information regarding the availability of the articles and delivery times are without guarantee and can be changed at any time without notice. Most products can, however, be reproduced, which only results in a delay in delivery. If the goods ordered are not in stock or are no longer available after receipt of the order, the customer will be informed immediately.

 

5. RIGHT OF WITHDRAWAL

When purchasing products, the customer has the right to cancel the contract within 14 days after the goods have been dispatched (date postmark) of the unused goods. The postage costs for the return are borne by the customer. The customer is obliged to post sufficient postage for the returns. Returns that are not unused will be rejected by WERA DESIGN at the customer's expense and revocation is not possible.

When purchasing products that have been individually manufactured according to the customer's specifications, the contract can only be revoked as long as WERA DESIGN has not yet started manufacturing the product. The costs incurred between the conclusion of the contract and the revocation for the time required and research will be charged to the customer.

 

6. DELIVERY PERIOD

The delivery times are without guarantee. If the product is already in stock, it will be shipped within 1-5 working days after receipt of payment. If the product is manufactured for the customer, the delivery times individually agreed between the customer and WERA DESIGN apply. The customer has no right to terminate the contract or claim compensation as a result of WERA DESIGN failing to meet the delivery deadlines.

 

7. SHIPPING CHARGES

WERA DESIGN ships within Switzerland via the PostPac Economy package from the Swiss Post for CHF 7.00.

Shipments up to 500g to Europe are sent via small items from the Swiss Post for CHF 9.00.

In countries outside Europe we only ship on request.

If the shipment is undeliverable due to an incorrect address or for any other reason based on an error or oversight by the customer, the additional costs must be borne by the customer.

 

8. PAYMENT TERMS

The products are only delivered after receipt of payment. The payment options are credit or debit card and PayPal.

 

9. RESERVATION OF TITLE, WITHDRAWAL

The delivered goods remain the property of WERA DESIGN until all claims against the customer have been settled in full. In the event of default in payment, WERA DESIGN is entitled to withdraw from the contract and offer the goods for sale again.

 

10. PRICES

The prices stated on the website are in Swiss Francs (CHF) and do not include VAT. Prices and availability are without guarantee. Shipping costs are not included in the price. WERA DESIGN reserves the right to make price changes and errors.
For deliveries abroad, duties, taxes and fees may apply, which are not included in the total price shown. These are borne by the customer.

 

11. LIABILITY

Liability for any indirect damage and consequential damage caused by a defect is fully excluded.
Liability for direct damage is limited to the sum of the service or product purchased by the customer. This limitation of liability does not apply to direct damage caused by gross negligence or intent. The customer is obliged to report any damage to WERA DESIGN immediately.
Despite careful control of the content, WERA DESIGN assumes no liability for the content of its own website, external links or third-party content.

 

12. PRIVACY POLICY

WERA DESIGN only collects personal data. WERA DESIGN is entitled to pass on customer data which are essential for processing the order (e.g. for shipping) to third parties. Otherwise both parties, the customer and WERA DESIGN, are obliged to treat all data confidentially.

 

13. RESALE

Prior sale is generally possible after consultation with WERA DESIGN.
When selling WERA DESIGN products, the customer is obliged to link all pictures and shop items that contain WERA DESIGN products to the WERA DESIGN website or Instagram page.

 

14. COPYRIGHT

All images and texts on this website are protected and may only be used with the consent of WERA DESIGN.

 

15. CHANGES
These general terms and conditions can be changed by WERA DESIGN at any time.
The new version comes into force when it is published on the WERA DESIGN website.
For customers, the version of the General Terms and Conditions that is in force at the time the contract is concluded applies. Unless the customer has agreed to a newer version of the terms and conditions.

 

16. APPLICABLE LAW / PLACE OF JURISDICTION
These terms and conditions are subject to Swiss law. The place of jurisdiction is Basel-Stadt.
